Terms of Service
These Terms of Service ("Terms") are an agreement between you and Pibardos LLC ("we", "us") covering your use of the Helbreath Forever game, its servers and this website (together, the "Service"). By creating an account or playing, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service is a beta
Helbreath Forever is an unfinished, in-development project offered as a beta. Features may change, break or be removed, and the Service may be unavailable at times. We do not guarantee that any data will be preserved. We intend to wipe all character progress, levels, items and gold when the beta ends. Do not treat anything you earn in the beta as permanent.
2. Eligibility
You must be at least 13 years old, and old enough to consent to data processing where you live, to use the Service. If you are a minor, you may only use the Service with the involvement of a parent or guardian. Do not use the Service if you are barred from doing so by law.
3. Your account
- Provide accurate information, and keep your password and account secure.
- You are responsible for activity that happens under your account.
- Do not share, sell or transfer your account, and do not create accounts to evade a suspension.
- Tell us right away at support@pibardos.llc if you believe your account has been compromised.
4. Acceptable use
Be decent to other players and to the Service. In particular, do not:
- cheat, use bots, automation, modified clients or exploits, or otherwise gain an unfair advantage;
- attack, overload, probe, scan or disrupt the Service or its infrastructure, or try to access it other than through the intended game client;
- reverse engineer the server or extract data other than as allowed by law;
- harass, threaten, defame or discriminate against others, or post unlawful, hateful or sexually explicit content;
- impersonate our staff or other players, or choose usernames or character names that infringe others' rights or are offensive;
- use the Service for anything illegal, or in a way that harms us, other players or third parties.
5. Characters, names and content
You are responsible for the names and content you create. We may remove or rename content, or suspend an account, if it breaks these Terms. You grant us the permission we need to store, display and process your in-game content so we can operate the Service.
6. Virtual items
Characters, items, currency and other in-game rewards have no real-world monetary value, are not your property, and cannot be exchanged for money or goods. They may be modified, reset or removed at any time, including as part of a beta wipe. The Service is currently free, and there are no purchases to refund.
7. Intellectual property and fan project
Helbreath Forever is an unofficial, fan-made project. "Helbreath" and its original artwork, music, names and marks belong to their respective owners. This project is not affiliated with or endorsed by the original rights holders. Original assets are used under the permissions held by the project owner. Our own code and original contributions to this site remain ours or our licensors'. Nothing in these Terms grants you rights to the Helbreath brand or its assets.
8. Third-party services
The Service uses third-party providers, including for authentication, email delivery, hosting and DNS. Their terms may also apply to those parts of the experience. See the Privacy Policy for details.
9. Suspension and termination
We may suspend or end your access if you break these Terms, if we believe it is necessary to protect the Service or other players, or if we discontinue the Service. You can stop using the Service and ask us to delete your account at any time.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free or free of harmful components, or that data will not be lost.
11. Limitation of liability
To the maximum extent permitted by law, Pibardos LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim (which, for a free beta, may be zero) or twenty US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Pibardos LLC from claims and costs arising out of your misuse of the Service or your breach of these Terms.
13. Changes to these Terms
We may update these Terms as the game changes. We will revise the date at the top and, for material changes, give a more prominent notice in the game or by email. Continuing to use the Service after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state in which Pibardos LLC is organized, without regard to conflict-of-law rules. Nothing here limits any consumer rights you have where you live.
